Family-Based Immigration

U.S. family-based immigration covers the pathways available to U.S. citizens and lawful permanent residents who want to bring a spouse, fiancé(e), or close family member to the United States. For Europe-based clients, the two most common pathways are the CR-1/IR-1 spouse visa and the K-1 fiancé(e) visa.

Each pathway has its own requirements, timelines, and trade-offs. The right choice depends on whether the couple is already married, where they intend to live during the process, how soon the foreign spouse needs to enter the United States, and whether work authorization is needed quickly upon arrival.

The Two Main Pathways

CR-1 / IR-1 Spouse Visa

For couples who are already married. The CR-1 (conditional resident) is issued when the marriage is less than two years old at the time of admission to the United States; the IR-1 (immediate relative) is issued for marriages older than two years. Both result in lawful permanent residence — a green card — upon entry to the U.S. Processing is handled through USCIS and the U.S. embassy in the foreign spouse’s country of residence.

K-1 Fiancé(e) Visa

For couples who are engaged but not yet married. The K-1 allows the foreign fiancé(e) to enter the United States to marry the U.S. citizen petitioner within 90 days of arrival. After marriage, the foreign spouse files for adjustment of status to obtain a green card. Adjustment of status is a separate service.

The right pathway depends on the couple’s circumstances — whether they are already married, where they currently live, and what their plans are for entering and settling in the United States. Each option has its own timeline, cost structure, and implications for work authorization upon arrival.
